TERMS & CONDITIONS

These Terms & Conditions explain the basis on which Tarmacadam Surfacing London, operated by TAR SURFACING LTD, provides quotations and surfacing services and the terms applying to use of this website.

2. APPLICATION OF THESE TERMS

These terms apply to the use of this website and, where incorporated into or referred to by a quotation, order or agreement, to surfacing and associated services provided by TAR SURFACING LTD.

Your individual quotation or written agreement may contain additional project-specific terms. If there is a conflict between these general terms and an expressly agreed project-specific term, the project-specific term will normally take priority for that project.

Nothing in these terms removes or restricts rights that cannot lawfully be excluded under applicable consumer law.

3. QUOTATIONS

Quotations are prepared on the basis of the information available to us at the time, including information supplied by the customer and, where applicable, observations made during a site visit.

Unless stated otherwise in the quotation:

  • A quotation is not an obligation on either party to proceed.
  • The quotation covers only the work expressly described within it.
  • Additional or changed work may result in an additional charge.
  • Quotations may have a stated validity period.
  • Prices may be subject to VAT where applicable.

A quotation may need to be revised if relevant information supplied to us was incomplete or inaccurate, or if site conditions materially differ from those reasonably apparent when the quotation was prepared.

4. FORMATION OF A CONTRACT

A contract is normally formed when a quotation or proposal is accepted by the customer and we confirm that we have accepted the instruction to carry out the work.

Acceptance may take place by signed agreement, email, electronic confirmation, payment of an agreed deposit or another method expressly agreed between us.

The contract consists of the agreed quotation or specification, any agreed variations and these Terms & Conditions where they have been incorporated into the agreement.

5. DEPOSITS & PAYMENTS

Any deposit, staged payment arrangement or payment date will be stated in the quotation, invoice or other agreed project documentation.

Customers must make payments by the dates agreed between the parties. We may issue invoices for deposits, stages of completed work or the balance due on completion, depending on the arrangement for the project.

If a payment becomes overdue, we may contact the customer and, where reasonable and lawful, suspend further work until the outstanding payment issue has been resolved.

Business-to-business contracts may be subject to statutory rights relating to interest and recovery costs on late commercial payments where applicable.

6. PROJECT DATES

We will make reasonable efforts to carry out the work on agreed or estimated dates.

Surfacing work can be affected by circumstances such as:

  • Adverse weather.
  • Unsafe working conditions.
  • Material availability.
  • Access restrictions.
  • Unexpected ground or site conditions.
  • Delays caused by third parties or utilities.
  • Events outside our reasonable control.

Where a delay occurs, we will seek to communicate revised arrangements as reasonably practicable.

Unless a completion date has expressly been agreed as a strict contractual deadline, dates should not automatically be treated as guarantees that cannot change because of legitimate site or weather-related circumstances.

7. CUSTOMER RESPONSIBILITIES

The customer is responsible for providing reasonable and safe access to the site and informing us of relevant information that may affect the work.

This may include information about:

  • Underground pipes, cables, drainage or other services.
  • Private utility installations.
  • Known ground problems.
  • Access restrictions.
  • Boundary issues.
  • Restrictions imposed by landlords, management companies or other owners.
  • Planning or property restrictions relevant to the proposed work.

Unless expressly included in our quotation, obtaining planning permission, landowner permission or other property-related approvals remains the customer's responsibility.

8. UNDERGROUND SERVICES

Customers should disclose known underground services and other hidden site features before work begins.

Where drawings or service plans are available, these should be supplied to us before excavation or groundwork takes place.

We will take reasonable care during the work, but underground services or structures that were not reasonably identifiable or disclosed may require additional work or changes to the project.

9. UNFORESEEN SITE CONDITIONS

Surfacing work frequently involves existing ground and structures that cannot be fully assessed until work begins.

Examples may include:

  • Unexpectedly weak or unstable ground.
  • Previously buried material.
  • Failed sub-base.
  • Hidden concrete or foundations.
  • Unknown drainage.
  • Underground services.
  • Contaminated or unsuitable material.

If an unforeseen condition materially changes the work required, we will discuss the issue with the customer and agree any significant additional work or change in cost before proceeding where reasonably practicable.

10. VARIATIONS & EXTRA WORK

A customer may request changes or additional work after the original quotation has been accepted.

Where a variation affects materials, labour, machinery, preparation or project duration, the price may also change.

Where reasonably practicable, significant variations and their effect on price will be agreed before the additional work is undertaken.

11. MATERIALS & APPEARANCE

Tarmac, aggregates and associated surfacing materials are functional construction materials. Natural and manufacturing variations may occur between different deliveries or sections of material.

New tarmac may also differ visually from older adjoining surfaces. Colour and appearance can change as materials weather and age.

Repairs and patches should not be expected to be visually invisible when joined to older surrounding tarmac.

12. DRAINAGE & WATER

Where drainage work forms part of the agreed specification, it will be described within the project quotation or related documentation.

Tarmac surfaces normally require appropriate falls and drainage to manage surface water. Existing site levels, neighbouring land, drains and other physical restrictions may affect what can practically be achieved.

Customers should inform us of known historic drainage or flooding issues before work begins.

13. SUBCONTRACTORS & SUPPLIERS

We may use suitably selected subcontractors, suppliers, plant operators or other third parties to assist with parts of a project where appropriate.

TAR SURFACING LTD remains responsible for its contractual obligations to the customer where work is provided under our contract.

14. WASTE & SITE CLEARANCE

Removal of excavated material, spoil or other waste will be included only where specified or reasonably implicit within the agreed scope of work.

Items unrelated to the agreed surfacing work are not automatically included in site-clearance obligations unless expressly agreed.

15. COMPLETION & INSPECTION

Customers should raise any concerns about the completed work as soon as reasonably practicable after becoming aware of them.

Where a genuine defect in our work is identified, we should be given a reasonable opportunity to inspect the issue and, where appropriate, put the work right.

Nothing in this section affects a consumer's statutory remedies where services have not been performed with reasonable care and skill or otherwise fail to conform to the contract.

16. CONSUMER CANCELLATION RIGHTS

If you are a consumer and the contract is entered into entirely at a distance or away from our business premises, you may have a statutory right to cancel the service contract within 14 days of the contract being made.

Where that statutory cancellation right applies, you do not need to give a reason for cancelling.

Starting work during the cancellation period: if you expressly ask us to begin providing services during an applicable 14-day cancellation period, you may be required to pay a reasonable amount for services supplied before you tell us you wish to cancel. Where the service has been fully performed after the legally required request and acknowledgement, the statutory cancellation right may end.

The statutory cancellation rules contain exceptions and do not apply to every type of contract or circumstance.

Where a statutory cancellation right applies, any required cancellation information will form part of the contract information supplied to you.

17. CANCELLATIONS OUTSIDE STATUTORY RIGHTS

If a customer wishes to cancel after any statutory cancellation period has expired, or where no statutory cooling-off right applies, we ask that the customer contacts us as soon as possible.

Any amount payable following cancellation will be assessed reasonably according to matters such as work already undertaken, materials reasonably ordered or committed to the project, and other actual costs arising from the cancellation.

We do not seek to impose disproportionate cancellation charges or automatically retain payments where doing so would be unfair or unlawful.

18. MODEL CANCELLATION FORM

Where you have a statutory right to cancel, you may use the following form, although you do not have to use this wording. A clear statement telling us that you wish to cancel is sufficient.

19. OUR STANDARD OF SERVICE

We will provide our services with reasonable care and skill and in accordance with the agreed description of the work.

Where no specific completion time has been agreed, consumer services will be performed within a reasonable time taking into account the nature of the project and relevant circumstances.

20. GUARANTEES & WARRANTIES

Any specific guarantee or warranty offered for a project will be set out in writing within the quotation, contract or separate guarantee documentation.

Nothing on the general website should be interpreted as creating a specific contractual guarantee unless that guarantee is expressly confirmed as applying to the customer's project.

Any contractual guarantee is additional to statutory consumer rights and does not replace rights provided by law.

21. LIABILITY

Nothing in these terms excludes or restricts liability where it would be unlawful to do so, including liability that cannot legally be excluded or limited under consumer protection law.

We do not exclude responsibility for death or personal injury caused by negligence, fraud or fraudulent misrepresentation.

Subject to applicable law, we are not responsible for loss or damage that was not caused by a breach by us or that could not reasonably have been foreseen when the contract was entered into.

Different rules may apply to losses suffered by business customers, and any project-specific business terms will be identified separately where applicable.

22. EVENTS OUTSIDE OUR CONTROL

We will not be treated as having failed to perform solely because work is temporarily prevented or delayed by circumstances genuinely outside our reasonable control.

We will take reasonable steps to minimise disruption and keep the customer informed where such circumstances materially affect the project.

If a substantial delay makes completion impractical, the parties will discuss the appropriate way to bring the contract to an end and the treatment of work and costs already reasonably incurred.

If you are unhappy with any aspect of our service, please contact us so that we have an opportunity to investigate and respond.

28. CHANGES TO THESE TERMS

We may update these website Terms & Conditions from time to time. The version applying to a particular contracted project will normally be the version incorporated into or supplied with that agreement, together with any subsequent changes agreed between the parties.
